If your relationship breaks down and you are unmarried, you should seek legal advice with regard to any property or assets. You may have thought that you were protected by the concept of a ‘common law’ husband/wife however this is not recognised in law.
Meet the Litigation legal team
Seperation Disputes for unamarried couples are dealt with in the Civil Court (unlike divorce, which is dealt with in the Family Court) and so the procedure and law is entirely different. Disputes generally concern the family home; whether it has to be sold and divided, or who can live there. You do not necessarily need to be one of the legal owners of the property to have a potential claim.
We also advise on cohabitation agreements entered into at the start of a relationship to help alleviate any issues should the relationship end.

2 months agoMichelle and team at Shentons were brilliant at handling our property purchase. I wouldn’t hesitate to use them again or recommend them. The quality of work and service was excellent, Michelle is on the ball and responsive to emails, she pushed the other side and made sure we were comfortable and informed at every step. Despite being thrown some curve balls Michelle remained calm, and dealt with all of them in an efficient but thorough manner. From quote to completion everything her and her team did was excellent, and in line with the estimate given which for first time buyers allowed us to budget without fear of massive final bill. It’s nice to know what you are getting into. And finally to top it off they are all lovely approachable people that I wouldn’t hesitate to trust with such a big purchase or sale going forward. If you want the job done properly I wouldn’t use any other firm.Posted on Google

10 months agoMy whole experience of Rachel and Chloe representing me, guiding myself through a very stressful court process was second to none. They are highly professional, highly experienced in their field and gave solid, clear advice. I can't recommend them and Shenton's enough. Thank you. - PPosted on Google
