If your child has an Education, Health and Care Plan (EHCP) and is transferring to a new phase of education, mark these dates in your calendar
Why are these dates important?
By these dates, your Local Authority (LA) must have, held a transition review meeting and confirmed your child’s new educational setting in section I of your child’s EHCP
What do you need to do?
The most important thing to do is to schedule your transition review as soon as possible, ideally in the autumn term, so that if you do not agree with the educational setting that the LA names, there is time to appeal the decision.
Remember:
The LA has 12 weeks from the date of your meeting to make an decision or issue a draft plan for you to review, it is only after this that you receive your right of appeal.
If you don’t hear from the LA before the deadline, or a setting you do not want is named, please get in touch asap so we can either support you to obtain confirmation of setting and/or advise you as to the Appeal process as Rights of Appeal to issue proceedings are time limited.
