Throughout history, humans have used their names to communicate their identities, from profession-based surnames such as Smith or Porter, to given names rooted in the values of the parents such as Charity or Earnest.
Some strive to be recognised for who they are, and this process is often long and challenging. For some, a key step is changing their name. However, many people do not necessarily know how to go about doing this and can be worried about the time it can take to do so.
The process for changing your name can be relatively straightforward depending on which avenue you wish to take. You can change all or part of your name by either Deed Poll or a Change of Name Deed, provided that your chosen name is not offensive.
If you change your name by Deed Poll, it is ‘enrolled’ with the Royal Courts of Justice. This is considered the more formal route; you fill in an application and send it to the Court for approval. This can take time and is public, as all enrolled changes of name are published in the London Gazette.
For those seeking a quicker and more private process, a Change of Name Deed can be prepared by a Solicitor. Once this Deed is signed and witnessed, you can use it to change your name with the relevant institutions, such as your doctor’s surgery, DVLA, HM Passport office and the bank.
To change the name of a child, the same options apply, however, you need the consent of the people who have Parental Responsibility before progressing with either of these two methods.
If one person with Parental Responsibility does not consent, then an application to the Court may be required to obtain an Order giving permission for the name to be changed, known as a Specific Issue Order.
